New clarifications from ONJN regarding the application of law no. 107/2024

Last week, an important notice was published on the ONJN website for the attention of gambling organizers regarding the application of law no. 107/2024 which prohibits gambling halls in localities with less than 15,000 inhabitants, a law promulgated by President Klaus Iohannis on April 17.

From that announcement, all those interested understood that in localities with less than 15,000 inhabitants, gambling organizers could continue their activity until the authorizations expired.

In a new announcement posted on the ONJN website, for the attention of gambling organizers, the following clarifications were added:

“On the date of entry into force of the above-mentioned legal provisions, there are legal relations created by administrative acts (decisions to grant authorizations for the exploitation of slot-machines) issued prior to the new provisions, which will produce their effects until the moment the termination of their validity, with the condition that the gambling organizers proceed, immediately, to relocate the slot machines in locations located in territorial administrative units with a population greater than 15,000 inhabitants.

Otherwise, the provisions of art. 17 para. (2) letter i) of GEO 77/2009 with subsequent amendments and additions regarding the organization and operation of gambling.”

Basically, the slot machines must be moved, immediately, in localities with a population of over 15,000 inhabitants.
